Terms for using the Vistario portal — for visitors, property seekers, and advertisers.

1. Operator and introduction
These Terms of Service ("Terms") govern the rights and obligations between the portal operator and its users. The operator is registered in the Czech trade register; identification details are listed below. By using the portal, the user agrees to these Terms.

2. Definitions
The following definitions apply throughout these Terms:
- Visitor
- Anyone who accesses the portal without registering.
- User
- A natural or legal person with a registered account on the portal.
- Advertiser
- A user who publishes property listings on the portal.
- Listing
- A textual, visual, or other communication published on the portal promoting a specific property.
- Service
- The full set of portal features (search, saving, advertising, contact, notifications, premium functions).
3. Nature and role of the portal
Vistario is an online listing platform that facilitates the display of international property listings and contact between seekers and advertisers. The operator is not a real-estate agency, is not a party to any purchase or rental agreement, and does not provide real-estate mediation. All contractual relationships, payments, viewings, legal reviews, tax, and local matters are handled exclusively between the user and the advertiser or the relevant parties in the property's country.
4. Registration and account management
Basic browsing is available without registration. Advanced features require an account. By registering, the user enters into a contract of indefinite duration.
- The user must provide accurate and current registration details.
- The user is responsible for keeping login credentials secure and for all activity carried out under their account.
- Each person may hold only one active account. Sharing an account with others is prohibited.
- The operator may suspend or terminate an account for breach of these Terms, without entitlement to a refund of unused prepaid services, where the breach is on the user's side.
5. Advertiser types and identification
Advertisers may be private individuals, sole traders, legal entities, or real-estate intermediaries (agencies, developers). The portal requires the following identification:
- Legal entities and sole traders in CZ/SK: company name or full name, business ID (IČO), registered address, billing e-mail.
- Foreign legal entities or sole traders: business name, registration identifier (EU VAT, registration number or equivalent per country), registered address.
- Private individuals: full name, contact e-mail, electronic declaration of authority to advertise the property (recorded with date and IP address via the profile confirmation feature).
- Real-estate agencies and developers may use bulk import via JSON API (token-based authentication); the token is linked to the advertiser account and is managed under Advertiser → Bulk import. The one-advertiser-per-account rule applies.
The operator may request proof of authority to offer a property (e.g. mediation contract, land register extract, power of attorney). If the advertiser fails to provide proof within the specified period, the operator will remove the listing.
6. Listing rules
Advertisers must comply with the following rules:
- Only properties located outside the Czech Republic may be advertised.
- Listing content must be truthful, accurate, current, and must not mislead users.
- The advertiser must hold valid authority to offer the property at the time of publication (ownership, power of attorney, mediation agreement).
- Texts, photos, and other content must not infringe copyright, personality rights, or other third-party rights.
- Listings must not contain false or misleading information about price, specifications, location, or legal status of the property.
- Each specific offer may appear as a single listing; duplicate listings will be removed.
7. Licence to listing content
By uploading a listing and all its content (texts, photos, descriptions), the advertiser grants the operator a non-exclusive, worldwide, royalty-free licence to use that content for the duration of publication and a reasonable period thereafter for the purposes of operating the portal, promotion, and technical processing. The advertiser declares that they are authorised to grant this licence and that all rights to the content are cleared.
The operator may display content via partner distribution channels and adapt it to meet those channels' technical requirements. The operator does not provide commercial use of listing content to third parties without the advertiser's consent.
8. Prohibited content and misuse
The following are prohibited on the portal:
- Advertising properties without valid authority to offer them.
- Submitting deceptive, misleading, or offensive content.
- Creating fake or duplicate accounts.
- Automated extraction of portal data (scraping, crawling) without the operator's written consent.
- Circumventing the portal's payment or authentication systems.
- Distributing spam, unsolicited commercial messages, or contacts outside the portal system.
9. Pricing, payments, and invoicing
Basic portal features (browsing, registration, saving) are free of charge. Premium advertiser features are governed by the current price list available on the portal.
- Prices are stated in CZK or EUR. VAT is itemised where the operator is a VAT payer; otherwise the price is final.
- The operator reserves the right to adjust EUR-denominated prices based on the current exchange rate published by the Czech National Bank (CNB). An exchange rate change does not affect ongoing fixed monthly subscriptions until the user has been demonstrably notified of the price change with the option to cancel the service.
- Payments are processed through a certified payment service provider (Stripe). The operator does not have access to the user's payment details.
- Prepaid subscription periods or listing packages are non-refundable if the advertiser breaches these Terms.
- The operator may unilaterally change the price list with at least 14 days' notice; the advertiser may terminate the contract before the change takes effect.
10. Ranking, recommendations, and AI filters
The portal ranks listings based on a combination of the parameters listed below, in accordance with EU Regulation 2019/1150 (P2B):
- Relevance to search criteria (location, type, price, area) – highest weight.
- Date added or last updated.
- Paid promotion – listings using paid promotion are clearly labelled.
11. Moderation, content reporting, and DSA
In accordance with EU Regulation 2022/2065 (DSA), the operator moderates portal content and allows illegal or harmful content to be reported.
- Any user may report a listing via the “Report” function on the listing or by e-mail to [email protected].
- The operator will assess reports and decide on retention, modification, or removal of content without undue delay.
- An advertiser whose listing has been removed will receive a statement of reasons and may request review of the decision within 14 days.
- Repeated or serious breaches of these Terms may result in restriction or termination of the advertiser's account.
12. Limitation of liability
The portal does not provide legal, tax, financial, or investment advice. All information on the portal is for informational purposes only.
- The operator is not liable for the accuracy of listing content or the compliance of an offer with local law in the property's country.
- The operator is not liable for the outcome of transactions between users and advertisers.
- The operator is not liable for temporary unavailability of the portal due to maintenance or force majeure.
- The operator's total liability to any user for damages arising from use of the portal is limited to the amount of fees actually paid by that user in the 12 months preceding the damage.
13. Short-term rentals
Short-term rentals (holiday, seasonal) are subject to specific local rules in many countries: licences, maximum nights, guest registration, tourist tax, energy certificates, etc. The portal does not guarantee or verify compliance with these rules.
14. Termination of the contractual relationship
A user may delete their account at any time via account settings or by contacting [email protected]. The operator will deactivate the account within 30 days of receiving the request; after deletion, personal data is processed exclusively in accordance with the Privacy Policy. The operator may terminate account access for serious or repeated breaches of these Terms, with written notice and a 7-day remedy period, unless the breach constitutes unauthorised access or another serious criminal act.
15. Final provisions
These Terms are governed by the law of the Czech Republic. Disputes will be resolved by the competent courts of the Czech Republic; consumers may also contact the Czech Trade Inspection Authority (www.coi.cz). The operator may unilaterally amend these Terms with at least 14 days' notice via e-mail notification or a prominent notice on the portal. Continued use of the portal after the amended Terms take effect constitutes acceptance of the amendments.
